Repeat Offender in Sex Crimes Against Elderly Receives 2-Year Sentence on Appeal
Criminal Division 1 of the Cheongju Branch of the Daejeon High Court sentenced Mr. A, in his 40s, to two years in prison on the 12th, upholding the original sentence for charges including indecent assault and violation of the Sex Crimes Punishment Act. The court also ordered a 10-year ban on Mr. A working at institutions related to children, adolescents, and disabled persons. Both Mr. A and the prosecution had appealed, arguing the sentence was unfair, but the appellate court stated it was difficult to consider the original sentence to be outside the reasonable scope of discretion, and upheld the first trial's ruling.
Mr. A was brought to trial for allegedly forcibly touching the bodies of three elderly individuals in Goesan, North Chungcheong Province, in June of last year. This offense occurred just three months after his release from prison, where he served a three-year sentence for sexually assaulting an 80-year-old woman in February 2022. Investigations revealed that Mr. A, who was subject to registration of his personal information, failed to report his updated information after his release.
The first trial court pointed out that the defendant had repeatedly committed offenses during the period of recidivism for similar crimes. The court ruled that the victims likely experienced significant sexual discomfort and psychological shock.
