Legal community pushes back against Obama-appointed judge seeking to disbar Trump's attorneys

Kathleen Williams, a U.S. federal judge appointed by former President Barack Obama, has formally requested the bar association to revoke the licenses of key Department of Justice (DOJ) figures, including DOJ Attorney General Todd Blanche, along with attorneys for President Donald Trump. The case stems from a trial involving an agreement designed to protect the president’s family and related businesses from specific federal tax audits and lawsuits.

Through a publicly released opinion, Judge Williams formally referred Alejandro Brito, an attorney for President Trump, to the Florida Bar. The opinion was also transmitted to the authorities handling existing disciplinary reviews for DOJ Attorney General Blanche and Associate Deputy Attorney General Stanley Woodward. Whether the legal licenses of these senior DOJ officials will ultimately be suspended or revoked hinges on the decisions of the bar association’s review committees.

Criticism of the judge's order has been voiced by constitutional law professors, including Christina Rivera Gonzalez of a Catholic university in Florida. She stated that she would refuse to teach legal theories justifying disciplinary measures that deprive attorneys of their reputations, licenses, and livelihoods. She pointed out that because bar associations have the authority to suspend legal licenses within their jurisdiction, the judiciary using this as leverage risks disrupting the balance within the legal profession.

Professor Gonzalez Rivera warned that if such judicial pressure continues, it could lead to the unintended consequence of disproportionately empowering elite lawyers with specific political leanings. She added that this could lead to conservatives avoiding public service at the DOJ, causing operational disruptions for federal prosecutorial organizations. The disciplinary pressure on defense counsel and senior DOJ officials has sparked controversy over political bias within the legal community, and the outcome of this case is likely to serve as a structural obstacle to the recruitment and activities of future lawyers dedicated to serving the Department of Justice.
