Lawsuit Holding Google Accountable for AI Hallucinations Heads to Trial

A historic trial examining corporate accountability for falsehoods generated by artificial intelligence is set to begin. In October of last year, Robby Starbuck filed the lawsuit seeking at least $15 million in damages, alleging that Google's AI models—Bard, Gemini, and Gemma—generated false claims that he committed sexual assault and child sex crimes. The issue was exacerbated by the fact that Google's AI continued to produce the misinformation even after receiving multiple cease-and-desist letters starting in 2023, resulting in the false claims being exposed to approximately 2.84 million users.

The Delaware Superior Court judge ruled that the plaintiff had presented sufficient facts to sustain a claim for emotional distress, noting that discovery procedures are necessary to examine Google's internal AI documents and decision-making processes. This ruling will allow for an investigation into the technical causes and background behind the generation of false information by Google's AI.

This case is expected to serve as a landmark precedent in determining the extent of corporate liability when the phenomenon of "AI hallucination" damages an individual's reputation.
