Kim Kun-hee's Camp Mounts Direct Legal Rebuttal Against Extended Detention Warrant

Lady Kim Kun-hee has engaged in a legal battle over the very issuance of her detention warrant.

The special investigation team led by Special Prosecutor Min Jung-ki, which is handling the Kim Kun-hee case, requested that the Supreme Court issue an ex officio detention warrant for Lady Kim in the 'quid pro quo appointments' case. Her detention period expires on the 31st. The special prosecutor sought an additional warrant on the 15th in order to keep her trial proceeding while she remains in custody. In response, Lady Kim's defense counsel submitted an objection brief to the Supreme Court on the 16th, mounting a direct rebuttal.

Whether the Detention Period Limits Are Being Circumvented Is the Key Issue

In the objection brief, Lady Kim's camp argued that "the issuance of the detention warrant constitutes a circumvention of the statutory limits on detention periods." Their logic is that since the Act on the Aggravated Punishment of Specific Crimes sets an upper limit on detention periods, successively issuing new warrants to effectively extend her detention amounts to evading the limits set by law. They point out that detention period limits are a safeguard designed to protect the physical liberty of suspects and defendants, and that repeatedly seeking warrants to nullify them undermines the purpose of the system.

The special prosecutor's position, however, differs. The special prosecutor appears to believe that even if the detention period expires, a new warrant based on separate grounds is necessary if concerns over evidence destruction or flight remain while the trial continues. If the Supreme Court issues a new warrant, Lady Kim will remain in detention and stand trial rather than being released. An ex officio detention warrant is a system under which the court itself determines the necessity of a defendant's detention and issues the warrant upon a request from prosecutors or a special prosecutor.

An Emerging Variable in the Trial Landscape

This warrant dispute has a direct bearing on the proceedings of the cases in which Lady Kim is implicated. If the warrant is rejected, she will be released as of the 31st and her trial will switch to a non-custodial format; if issued, her detention will continue. Either way, the Supreme Court's ruling itself is bound to become the legal benchmark for detention extensions in similar future cases, giving it significance beyond this individual case.

Amid political movements such as the briefing by People Power Party Supreme Council spokesperson Park Chung-kwon calling for a special prosecutor into the stock gambling case and a state investigation, concerns have been raised that the legal judgment could be consumed as part of political wrangling rather than kept separate. The prevailing view in the legal community is that both ruling and opposition parties should not exploit the detention issue as political material.

The Supreme Court's Ruling and the Schedule Ahead

The path forward hinges on whether the Supreme Court issues the warrant. The court is expected to weigh the grounds for detention presented by the special prosecutor against Lady Kim's camp's legal rebuttal. If issued, her camp is likely to pursue further legal responses, including a motion to cancel the warrant. If rejected, the special prosecutor's trial strategy could face setbacks.

Given reports that the comprehensive special prosecutor's prosecution has already run into difficulties, with criticism of 'poorly built cases' in multiple trials, this warrant ruling is set to serve as a litmus test for the overall credibility of the special prosecutor's investigation and indictments. Ultimately, the answer will come not from the warrant number, but from the deliberation of legal principles.
