Prosecutors Appeal Father's Sentence in Child Abuse Neglect Case

Prosecutors have appealed the first-instance court's sentence, deeming it too lenient, in a case where a father allegedly caused his four-month-old son's death through abuse and neglect. The prosecution had sought a 10-year prison term for the father, B, but the court ultimately handed down a sentence of 4 years and 6 months, which prosecutors believe falls short of public legal sentiment. Based on the judgment that the first-instance sentence for the father, accused of child neglect, was unjust, prosecutors are requesting a stricter application of the law from the court.

This case involves the mother, A (34), accused of prolonged abuse and neglect leading to the death of her son, Haedeun (pseudonym), and the father, B (36), accused of being aware of the abuse and failing to protect the child.

On April 23, 2022, the Suncheon Branch of the Gwangju District Court sentenced the mother to life imprisonment and the father to 4 years and 6 months in prison. The first-instance ruling analyzed that mother A did not feel maternal affection for the victimized child and committed the crime due to complex psychological factors, including resentment over not being able to hold a first birthday party for her eldest child. After childbirth, A harbored animosity towards Haedeun and began to express her anger toward the child as conflicts with her husband intensified. The ruling explicitly stated the mother's motive as 'lack of maternal affection,' indicating a need for a higher level of punishment for simple neglect charges.

The court pointed out that father B "neglected the responsibilities expected of him as a husband and father." The court added that it was not appropriate to consider the allegations of complicity in acts directly causing death or neglect as core aggravating sentencing factors for his punishment, as they were not included in the indictment.

If the life sentence for mother A is upheld, it would be the first case since the establishment of the child abuse homicide law in 2021 where the maximum legal penalty has been imposed without the combination of grave offenses. Prosecutors stated they would make every effort to maintain the prosecution's case if the defendants appeal.
