In the Busan region, there continue to be cases where sexual assault victims face difficulties in investigations because they miss the crucial period for response immediately after the incident. The direction and outcome of the investigation can change depending on the actions taken after reporting the assault. Many victims hesitate to report due to concerns such as, 'What's the use of reporting if there isn't enough evidence?' or 'Won't this just complicate things unnecessarily?'
However, in actual investigations, even without direct evidence, investigators comprehensively examine the consistency and specificity of the victim's statement, the victim's actions immediately after the incident, and the surrounding circumstances. Messages sent to acquaintances after the incident, call recordings, hospital treatment records, CCTV footage, and movement logs can all be used as important evidence. Securing evidence quickly is particularly crucial because mobile messages and location records can easily disappear over time, and witnesses' memories can also fade.
In Busan, there was a case where a woman, who was a victim of indecent assault by an acquaintance, visited a hospital immediately after the incident and kept consultation records. She later submitted these records along with KakaoTalk conversations and a memo detailing the events, which led to her account being recognized as credible and the perpetrator receiving a guilty verdict. On the other hand, similar cases where no records were kept immediately after the assault have been closed without charges due to difficulties in proving the case.
During the investigation phase, victims can receive protection such as the participation of a victim support person, video recording of statements, and the presence of a trusted companion. Separate from criminal proceedings, compensation for damages, including emotional distress, can be sought. In cases of workplace incidents, further actions may include disciplinary procedures or remedies through labor committees.
Attorney Lee Yong of Law Firm Ohyun stated that individuals who have experienced sexual assault should not try to handle it alone but must understand legal procedures and protection systems accurately to respond effectively. He emphasized that for those who have already experienced harm or are considering reporting, organizing the initial available materials and procedures can make a significant difference in the case outcome and the recovery process.
