Clause Mandating Automatic Dismissal of Military Objectors Unconstitutional

On the 27th, the Constitutional Court decided that the provision in the Military Service Act mandating the unconditional dismissal of individuals who refuse military duty is unconstitutional. The Court stated that "dismissal should be carried out only against those who evade military service without just cause," criticizing the current procedure for failing to provide an opportunity to demonstrate just cause before a dismissal notice is issued.

Following this decision, dismissal measures against military objectors must now undergo a process to verify the existence of just cause.

The Constitutional Court ruled that the National Assembly must amend the Military Service Act by February 29, 2028, while maintaining the provision's effectiveness until the revision is made. The decision concluded by urging the National Assembly to establish detailed criteria to determine what constitutes just cause for draft evasion.
