Elon Musk, a co-founder of artificial intelligence (AI) development company OpenAI, and current CEO Sam Altman are set to battle in court over the future of OpenAI. Musk has demanded up to $134 billion in damages from OpenAI and Microsoft, called for the dismissal of Sam Altman and OpenAI President Greg Brockman, and requested that OpenAI be restored to a non-profit organization.
OpenAI was originally launched as a non-profit organization, including a $38 million donation from Musk, with a public promise to develop technology for the benefit of the public. Musk, as one of OpenAI's co-founders, provided funding in 2015, during the company's early stages, alongside Sam Altman and others, pledging to uphold the non-profit mission of developing AI that benefits humanity. OpenAI was established as a non-profit upon receiving Musk's $38 million contribution.
Over time, claims emerged that the non-profit structure was insufficient to secure adequate funding due to intensifying competition and rising model development costs. Musk argues that OpenAI violated its initial promise to maintain its non-profit status by restructuring into a for-profit subsidiary. He has requested the court to dismiss Altman and Greg Brockman and reinstate the non-profit structure.
This trial will take place in Northern California. Elon Musk, Sam Altman, and Greg Brockman are expected to testify in court. Ilya Sutskever, Mira Murati, and Satya Nadella will also appear as witnesses.
