PM Kim Min-seok Raises Possibility of Emergency Intervention Over Samsung Electronics Strike
Prime Minister Kim Min-seok has officially stated that the government may consider all available response measures, including the invocation of "emergency mediation rights," if national economic damage is feared due to a Samsung Electronics strike. Emergency mediation rights are a potent measure allowing the government to intervene in labor-management relations when prolonged strikes severely threaten the public interest. It is a process that the Minister of Labor can initiate if a union's strike activities are deemed to pose a significant threat to the national economy. If invoked, strikes are immediately prohibited for 30 days, during which the Central Labor Relations Commission will facilitate mediation.
The Samsung Electronics union secured the right to lawful industrial action after mediation talks at the Central Labor Relations Commission broke down in March. Following successive mediation efforts by Minister of Employment and Labor Kim Young-joo on the 15th and 16th, both sides agreed to attend mediation again on the 18th. The company replaced its chief negotiator, Vice President Kim Hyeong-ro, and the union agreed to allow Vice President Kim's attendance, making concessions. With only three days remaining until the scheduled strike, the mediation on the 18th is widely perceived as the de facto final negotiation table.
