FTC Report (July 24): Fines levied in all 6 cases of large-scale collusion and unfair trade, accompanied by strict sanctions

Rising judicial risks for large conglomerates… Intensive crackdown system officially in full swing

The Fair Trade Commission (FTC) has recently announced a series of strong sanctions against numerous companies that have disrupted market order. These measures, targeting both collective and individual actions, are significant in that corporations belonging to large business groups were included as key regulatory targets. Unlike in the past, the Commission is pursuing immediate fines and criminal prosecution for every violation detected, regardless of economic impact or market share.

An analysis of specific FTC sanction data reveals that all six recently processed cases resulted in administrative penalties. This signifies the direct deployment of economic sanctions, rather than settling for mere recommendations or corrective orders. In particular, all six penalized companies were confirmed to be affiliates of renowned large-scale conglomerates. This serves as strong evidence that unfair practices by large corporations with market dominance, rather than small and medium-sized enterprises (SMEs), were the primary targets of this crackdown.

Sanction patterns by type and impact on market disruption

Examining the overall pattern of the uncovered violations, acts that undermine price competition in the market constitute the core. The FTC investigation found evidence that numerous companies met secretly to pre-arrange prices or engaged in bid rigging by agreeing not to infringe on each other's sectors. Such cartel behavior deprives consumers of choice and results in the artificial imposition of higher prices.

Also frequently observed in this round of measures were unfair transaction types where dominant market operators forced linked transactions or blocked competitors from entering the market entirely. (FTC Sanction Status based on Public Data)

Repeated violations by large conglomerates pose a serious obstacle threatening the health of the entire industrial ecosystem, extending beyond the harm to individual consumers. A single instance of collusion or unfair internal trading can spread across an entire group of affiliates, eroding the broader landscape for fair competition. Ultimately, innovative startups lacking capital are forced to abandon market entry, resulting in a noticeable slowdown in the adoption of new technologies and service improvements across the industry.

Qualitative strengthening of regulations and future implications

Recent cases of strict enforcement clearly demonstrate a shift in policy direction by regulatory bodies, as seen in public data. In the past, it was common for fines to be significantly reduced in exchange for voluntary reporting or the submission of statements of reflection. However, now that violation allegations are confirmed, benefits are minimized, and reporting procedures are being processed swiftly to pave the way for civil damages lawsuits.

In the second half of this year, the FTC’s comprehensive surveillance network regarding the abuse of market dominance and unfair subcontracting practices by large corporations is expected to exert even greater pressure. The policy stance will specifically focus on thoroughly preventing the recurrence of unfair transaction practices seen in traditional industries within new growth sectors such as artificial intelligence and bio.

Amidst global economic uncertainty, fair and transparent transaction practices are essential prerequisites for restoring the vitality of the domestic market. Routine legal violations by large corporations could risk becoming a critical liability that lowers the international credibility of the entire Korean market. Unless companies voluntarily establish robust compliance monitoring systems, strict macro-level sanctions are inevitable and will continue to expand.
