Elon Musk to Appeal OpenAI Lawsuit Loss
Tesla CEO Elon Musk has lost his lawsuit against OpenAI. A jury and judge at the U.S. federal court in Oakland, California, ruled in favor of OpenAI, and Musk announced he would immediately appeal the decision.
Musk had filed the lawsuit, claiming he provided initial funding for OpenAI's establishment but that the company deviated from its original non-profit purpose. Musk argued that OpenAI's formation of a for-profit entity and its partnership with Microsoft (MS) constituted unjust enrichment, violating their initial founding agreement.
However, the court determined that the lawsuit was filed after the statute of limitations had already expired regarding the timing of OpenAI's transition to a for-profit model and Musk's awareness of the alleged damages. During the trial, OpenAI presented evidence, including past email records, showing that Musk himself agreed that a transition to a for-profit entity was necessary while he was still on the board.
Evidence emerged suggesting Musk's intention to merge OpenAI with Tesla and exert control, weakening his claim that the lawsuit was filed to preserve OpenAI's original non-profit spirit. An OpenAI lawyer described the verdict as a "substantive ruling" and suggested Musk sought to use litigation as a weapon after being sidelined in the competition. The court's decision was based on the expired statute of limitations for Musk's claims and the counter-evidence presented by OpenAI.
