Four senior officials from the National Intelligence Service (NIS) have been referred to trial on charges of participating in insurrection during the December 3 martial law incident. The special counsel indicted former NIS Director Cho Tae-yong and former First Deputy Director Hong Jang-won, among others, on charges of assisting in an insurrection. According to Yonhap News, this indictment expands the judicial process surrounding the martial law incident to include the intelligence agency.

Background of the NIS Command Indictment

The emergency martial law declared by former President Yoon Suk-yeol on December 3, 2023, was lifted within six hours following a parliamentary vote. However, as the National Assembly, the Defense Ministry’s investigative authorities, and the Police Agency’s National Investigation Bureau launched consecutive probes, the legal liabilities of those involved are being determined one by one. In particular, following the military leadership, the extent to which the intelligence agency—specifically the NIS—was involved in the implementation of martial law has emerged as a key issue.

As an agency directly under the President, the NIS is obligated to maintain political neutrality. Nevertheless, the actions of the command structure before and after the declaration of martial law became the focus of the investigation. The special counsel identified evidence that former Director Cho Tae-yong, former First Deputy Director Hong Jang-won, and two other command members cooperated with or participated in the execution of martial law, ultimately referring them to trial on charges of participating in insurrection.

Key Details and Significance of the Indictment

The gravity of this indictment lies in the charge of participating in insurrection. Insurrection is a crime involving inciting a riot with the purpose of disrupting the Constitution; the allegation is severe as it suggests public officials sworn to uphold constitutional order instead participated in subverting it. The special counsel appears to have acknowledged the charges based on circumstances suggesting former Director Cho mobilized the NIS or cooperated during the martial law situation, as well as evidence of former First Deputy Director Hong’s involvement.

A point of note is the reversal of the whistleblower’s position. Former First Deputy Director Hong had previously sided with those exposing the situation during the martial law period; however, the special counsel’s investigation concluded that he was also not free from allegations of participation. This demonstrates that the line between a simple whistleblower and a responsible party was redefined during the investigation process. Meanwhile, the investigation into Park Jung-hoon, head of the Defense Ministry's Investigation Headquarters, regarding the alleged cover-up of a "VIP's rage" during the 2023 Corporal Chae incident is proceeding slowly, allowing for judicial verification of corruption within the military and intelligence agencies to occur simultaneously.

Political Ramifications and Trial Variables

The indictment is expected to impact the political sphere. Former Director Cho, who previously served as the Director of the National Security Office at the Presidential Office, holds symbolic significance as his indictment on insurrection charges suggests the scope of responsibility for the martial law incident has expanded to the entire national security line. The ruling party views this as a normal conclusion to the special counsel’s investigation, while former President Yoon’s side denies the insurrection itself,预示ing a fierce legal battle over the validity of the charges during the trial.

In reality, with former President Yoon’s appeal trial currently underway, the indictment of the NIS command could act as a variable in the trial structure. According to Yonhap News TV reports, there are concerns that the credibility of the indicted individuals' statements could be attacked by former President Yoon’s defense. The robustness of the evidence secured by the special counsel is likely to determine the outcome of the trial.

Future Procedures and Outlook

As the trial begins in earnest, the battle over evidence regarding the establishment of insurrection participation charges is expected to take center stage. The extent of the NIS’s involvement in martial law and the decision-making process of the command structure will be scrutinized in court. In the same vein, as the trials of military personnel, such as Colonel Cho Sung-hyun, proceed in parallel, a comprehensive judicial judgment on the entire martial law incident is expected to be completed sequentially.

This indictment is also raised as a potential catalyst for enforcing political neutrality within intelligence agencies. Whether the NIS Act’s prohibition on political activities is effectively operational and whether institutional measures to prevent recurrence of similar situations will be established remain as future tasks for the National Assembly. As the special counsel’s investigation enters its final stages, the processing of remaining suspects and the trial results following the indictment are expected to complete the final puzzle of the judicial handling of the martial law incident.
