Appeals Court Upholds Human Rights Commission's Ruling on Gender-Restricted Job Posting
A job posting that allowed applications from only a specific gender was also deemed a 'mistake' at the appeals stage. The Seoul High Court, in the case (2026Nu3600), issued a ruling to the effect of upholding the National Human Rights Commission's decision.
The party dissatisfied with the decision contested it in court, proceeding through the appeals process following the first trial. However, the appeals court also upheld the Commission's decision to exclude the case from disciplinary review.
The court did not take issue with the Commission's judgment itself that it was a 'simple mistake.' With this ruling, the case was concluded without going through the Commission's disciplinary committee review.
