Defendant in Handcuffs Holding Infant Appeals for Parenting Environment; Court Cites 'Equity'

A defendant identified as A, who attended trial wearing handcuffs while holding her 9-month-old baby, has drawn attention by appealing for better parenting conditions behind bars. Appearing at the Seoul Northern District Court on the 14th for an appeal hearing regarding violations of the drug control act, A sought bail citing the poor childcare environment within the detention center and concerns for the child's health.

Under current law, female inmates are permitted to raise their children in correctional facilities until they are 18 months old. Legally, infant health management within these facilities is not neglected. National infant health check-ups and essential vaccinations are provided identically to those for general children through partnerships with medical institutions. If a child is sick, measures are taken to transfer them to an outside specialist hospital after examination by the internal medical department. The provision of essential childcare supplies such as formula, baby food, and diapers is also institutionalized, funded by the state budget.

However, structural limitations regarding the onsite environment remain. Due to the crowded and poorly ventilated nature of prisons, there is a heightened vulnerability to infectious diseases. As medical staff within the facility are primarily oriented toward adult inmates, there is a persistent risk of delayed response in emergencies.

Social perspectives regarding the treatment of inmates' children remain lukewarm. Correctional authorities and the courts maintain the principle that children should ideally be raised in general households outside of prison. However, the majority of inmates are unmarried mothers or lack the family support necessary to leave their children with relatives.

The appellate bench showed a cautious approach to the bail request on this day, citing that A had reoffended during a probation period. Presiding Judge Kim remarked, "We cannot disregard the need for fairness and consistency in sentencing compared to other cases."

In the United Kingdom, independent Mother and Baby Units (MBUs) are established in some women's prisons, allowing mothers and babies under 18 months to live together in a dedicated setting.
