The National Tax Service has reformed the system to treat private rental dwellings as general investment assets, strictly taxing capital gains. The past practice of avoiding taxes simply because five years had passed is no longer valid.

Currently, transferring a private rental apartment to a third party or parent follows the same tax rate structure as general investment housing. Progressive tax rates ranging from 6% to a maximum of 45% are applied to the capital gains (transfer price minus acquisition price, acquisition tax, brokerage fees, and other necessary expenses). Compared to the past when transfer income tax was exempt, the tax burden is felt much more directly.
However, benefits based on the holding period have not entirely disappeared. When disposing of a housing unit held for more than two years, the Long-Term Holding Special Deduction system applies, allowing for a deduction of up to 80% of the capital gains from the tax base. Conversely, if both the contract and balance payment processing were completed within 2022, one remains eligible for tax exemption under the former regulations.
Therefore, depending on the timing of the balance payment, a tax difference of tens of millions of won or more may occur. If the balance payment schedule is delayed while the parent receiving the title prepares the acquisition funds, there is a structural risk of a sudden surge in tax burden. Setting an accurate balance payment date from the contract preparation stage is essential.
Practical Limitations of the Temporary One-Household, Two-Home Ownership Exemption
Under current law, to receive tax exemption when selling a private rental apartment to parents, one must meet the requirements for the temporary one-household, two-home ownership exemption. To do this, the transferring child must have resided in Korea for more than one year, held the housing unit for more than two years, and must be a homeowner (having no other housing in their or their spouse's name) at the time of transfer.
Another option is the temporary two-home ownership exemption special rule. This involves a child holding an existing home, acquiring a new home to temporarily become a two-home owner, and then disposing of the existing home within a specific period. However, since this requirement requires the order of housing acquisition and the timing of disposal to match dates strictly defined by law, it is extremely difficult to align in a voluntary parental transfer situation. The same principles apply strictly when parents purchase their child's home.

Difference in Tax Burden: Pure Transfer vs. Gift with Consideration
Methods of title transfer are largely divided into sales (transfer) based on actual transaction prices and gifts. If one chooses sales, the progressive tax rate on capital gains, as mentioned earlier, must be borne. For example, if an apartment acquired for 600 million won is sold to parents for 900 million won, tax is calculated on the 300 million won gain after applying the Long-Term Holding Special Deduction. While it would have been 0 won before 2022 due to the 5-year holding requirement, the tax now drops to the tens of millions of won range.
As an alternative, "gift with consideration" (*budambu jeungyeo*) can be considered. Gift with consideration involves taxing gift tax on the amount remaining after deducting the debt the parent pays to the child from the house's market value, and taxing transfer income tax on the amount of the debt assumed. If the gifted amount falls within the parent's gift tax deduction limit, this can significantly lower the transfer income tax base. The key lies in calculating the "crossover point" between transfer tax and gift tax and adjusting the burden ratio.
Simulation for Cases with Hundreds of Millions in Won in Market Gains
In an environment where apartment prices have risen significantly and capital gains reach hundreds of millions of won, gift tax can paradoxically become cheaper than transfer tax. While the highest tax rate for transfer income tax reaches 45%, gift tax rates can be managed using the 10-year cumulative deduction limit. If a child transfers the title to a parent in the form of a pure gift, no transfer income tax is generated for the child, and only gift tax is calculated in the parent's name.
However, if the parent is already a multi-homeowner, avoiding the acquisition tax surcharge is impossible. Since acquisition tax applies heavy surcharge rates of 8% to 12% depending on the number of homes, taxes payable at the acquisition stage surge even if transfer income tax is saved. One must verify if the parent plans to dispose of existing housing first before title transfer to minimize property rights transfer costs.

When transferring a currently rented apartment to parents, the timing of the rental business registration cancellation must be coordinated carefully. If the parent does not rent it out again or reside there personally after the transfer, there is a high risk of being subject to acquisition tax surcharges. The sequential relationship between the rental business cancellation report and the ownership transfer registration has a decisive impact on tax calculation.
Additionally, if the unit was operated using Jeonse (deposit) support from institutions like the Korea Housing & Urban Guarantee Corporation (HUG), the deposit must be fully repaid and withdrawal procedures completed before the title transfer. Transferring ownership to a third party while the deposit remains can result in massive recovery fees or penalties for violating guarantee agency regulations.
Preventing Supplementary Taxation Due to Discrepancies Between Official and Actual Prices
Under tax law, the transfer price is based on the actual transaction price. If a child sells to a parent at a price significantly lower than the normal market price, the National Tax Service will re-evaluate the market value and recalculate the capital gains. Drafting a sales contract superficially just to transfer the title can result in a "tax bomb."
Conversely, if the actual transaction price is higher than the official published price (*gongsi-gagyeok*), the transfer tax increases by that difference. Before executing the title transfer, one must compare the officially published standard price registered on Homtax (NTS) with the actual market price of the apartment complex. It is safe to conduct a comprehensive simulation with a tax accountant beforehand to determine whether transfer income tax or gift tax is more advantageous and whether the gift can proceed within the parent's generation-specific deduction limits.
