End of Independent Counsel Probe Imminent: Opposition Forces Extension, Filibuster Clash Looms

Probe End Imminent for Independent Counsel; Bill Processing Becomes Political Flashpoint

As the deadline for the second independent counsel team's investigation approaches, the political sphere has entered a phase of extreme confrontation over the processing of related bills. The main opposition Democratic Party and its allies have set a strategy to forcibly pass the extension bill for the second independent counsel during a plenary session on the 20th. Conversely, the ruling People Power Party has forewarned that it will block this move with a filibuster—unlimited debate—making a head-on collision inevitable. As courts have recently rejected arrest warrants for key suspects just before the investigation period expires, controversy surrounding the probe's achievements is intensifying simultaneously. With negotiations for standing committee chairmanships also stalled, the National Assembly is facing a prolonged paralysis, unable to even elect standing committee chairs.

Series of Warrant Rejections and Legal Background of Extension Bill

The core issue with the current independent counsel law is ensuring the effectiveness of the investigation. The senior judge in charge of warrants at the Seoul Central District Court recently rejected consecutive arrest warrants for former Prosecutor General Shim Woo-jung and former Deputy Prosecutor General Jeon Mu-gon. The court's refusal to accept the warrant requests has amplified market doubts regarding the sufficiency of the evidence secured by the counsel team. These legal decisions have caused delays in scheduling the trials of key figures in the prosecution investigation.

The opposition-led extension bill was designed as a measure to thoroughly investigate suspicions that could not be resolved within the limited investigation period. During the process of probing remaining allegations, the second independent counsel team summoned key figures, including former Defense Minister Kim Yong-hyun. However, former Minister Kim has expressed his intention not to attend the summons, creating friction during the investigation. The legislative move to extend the counsel's authority and duration is directly linked to the opposition's justification for uncovering the substantive truth of the incident.

Call for 'People's Counsel' and Opposition's Political Stance

The leader of the main opposition party, who boycotted the Constitution Day ceremony, visited the scene of the blockade protests at the Jamsil counting center to present a clear alternative. He argued that prioritizing the opposition-led 'independent counsel for the people' is necessary to clarify current suspicions in the most transparent and certain manner, rather than rushing a recount. This is interpreted as a maneuver to secure both political neutrality and investigative fairness in tandem with the processing of the extension bill. As key figures mount legal defenses and strongly demand political neutrality and appropriate sentencing from the court, this represents an attempt to legislate the independence of the investigative agency.

The counsel team's submission of an opinion stating that the legal principles recognized in the case of former President Yoon Suk-yeol should be equally applied to the trial of Seoul Mayor Oh Se-hoon also adds to the controversy. The counsel's assertion that the possibility of losing office should not be used as a reason for guilt or sentencing is expected to set a precedent for curbing the defense arguments of high-ranking public officials in the future. The firm stance that losing the mayoralty is not a mitigating factor effectively exposes the reality of political and societal pressure on the judiciary without a shield.

Legislative Delays and Outlook for Livelihood Bills

As the political standoff over bill processing intensifies, the immediate casualty is the delay of essential policies. With negotiations for the second half of the National Assembly's standing committee composition yet to reach a resolution, there is even speculation that the Democratic Party might unilaterally occupy all 17 standing committee chair positions. This prioritization of ideological battles and political survival over dialogue and compromise means that economic deregulation policies desperately needed by the industry and welfare reform agendas directly affecting citizens' daily lives are at risk of being held hostage.

Unless the ruling and opposition parties collaborate to hold a normal plenary session on the 20th and address pending issues, including the counsel extension bill, the legislative vacuum could lead to a vicious cycle threatening the review of next year's budget bill. Furthermore, as seen in the postponement of First Lady Kim Keon Hee's counsel appearance from the 19th to the 21st due to health reasons, the legal defense strategies of the subjects of investigation will likely continue to act as variables intertwined with the legislative schedule. The outcome of this week's vote and whether the parties reach an agreement on committee compositions are expected to serve as key indicators determining the political landscape for the second half of the year.
